Terms and conditions of sale 

1) PURPOSE

The general terms and conditions of sale described below detail the rights and obligations of the company named above and any individual or legal entity visiting or making a purchase via www.my-tennis.fr, hereinafter referred to as the "Customer". Any service provided by the company therefore implies the Customer's unreserved acceptance of these general terms and conditions of sale.

These terms and conditions may be modified by My-Tennis at any time and without prior notice. The applicable terms and conditions are those in effect on the date of the Customer's order. In the event that a condition is lacking, it will be considered to be governed by current practice in the distance selling sector, in accordance with French law, which alone will be applicable.

2) PRODUCTS AND CONFORMITY

The products offered for sale are presented and accompanied by a description, in compliance with the standards applicable in France.
Elements such as photographs, descriptive texts and all other information and characteristics illustrating and/or accompanying the products are not contractual, which the Customer acknowledges.
Consequently, My-tennis shall not be held liable in the event of error or omission of any of these elements or in the event of modification of any of these elements by suppliers and/or publishers.

3) ORDER 

All orders will only be validated once payment has been accepted. My-tennis reserves the right to cancel or refuse an order in the event of a dispute with the Customer regarding a previous order. My-tennis may accept orders subject to availability. The Company in no way guarantees that products will be available for sale during a specific period and undertakes to notify (by email or telephone) any customer who has ordered a product that is not available as soon as possible.

If the amount of an order is debited for an unavailable product, the Company undertakes within 15 days, at the Customer's discretion, either to reimburse the Customer or to issue a credit note for the amount of the order.
In the event that one of the products in a multi-product order is out of stock, My-tennis will ship the remainder of the order. The Customer warrants that he/she is fully authorized to use his/her payment card or Paypal account to pay for his/her order, and that these means of payment provide access to sufficient funds to cover all costs of using the Company's services.

4) PAYMENT

Payment must be made in full at the time of ordering. At no time can the sums paid be considered as deposits or advance payments.
The customer pays for his order by credit card or with his Paypal account.
The Company retains ownership of the item until full payment has been received from the Customer. Purchases are made securely. For credit card payments (Carte Bleue, Carte Bleue Visa and e-Carte Bleue), all information communicated by the Customer to My-tennis is strictly protected and guarantees the conformity and security of each transaction.

5) PRICES

The prices of products displayed on www.my-tennis.fr are indicated in euros (€), all taxes included. Shipping costs will be indicated in the customer's basket, before the order is confirmed. The Company reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

Promotional prices by code or coupon are not cumulative and do not apply to discounted products.

 

6) DELIVERY

Products are shipped free of charge to mainland France for orders over €60 (including Corsica). For orders of less than €60 to mainland France, shipping costs will be €4.5.

In addition to mainland France, we ship to the rest of Europe (EU and non-EU), North Africa and the rest of the world. Shipping costs for these territories will be indicated when the order is finalized.
Delivery times are for guidance only and are not guaranteed. Accordingly, any reasonable delay shall not entitle the Customer to :

• the award of damages
• order cancellation

The transport risk is borne entirely by the Customer.

In the event that goods are missing or damaged in transit, the Customer must make all necessary reservations to the carrier and to My-Tennis upon receipt of said goods. These reservations must be made in writing within five days of delivery, and sent to My-Tennis by registered mail. 

7) RIGHT OF WITHDRAWAL

In accordance with article L121-20 of the French Consumer Code, the customer has the right to retract and return products purchased on the www.my-tennis.fr website within 14 clear days from the date of delivery (as evidenced by the postmark).

To exercise the right of withdrawal, the Customer must contact the Company at the following address: [email protected]. Once the right of withdrawal has been invoked, the Customer has 14 days to return the product(s). Products must be returned in their original packaging and condition (tried on, but not worn) to the address indicated by My-tennis customer service.

The Customer will be reimbursed by automatic credit within 30 days of My-tennis receiving the product(s).
The refund will be equal to the price of the items returned by the customer, excluding delivery charges.

The Customer may only request an exchange for a different size from the product(s) initially ordered. The Customer must return the product(s) at his/her own expense, except in the event that he/she has received a product with a manufacturing defect or that does not correspond to the Customer's initial order.

The return or exchange is at the Customer's risk. The product(s) must be returned in its original packaging, in its original condition, new, unworn, unwashed, accompanied by the return slip. The returned product(s) will be exchanged, subject to availability, within a maximum of fifteen (15) days of receipt by My-tennis. If the product to be sent is unavailable, the Customer will receive a credit note for the amount of the order.

8) LIMITATIONS OF LIABILITY

My-tennis is subject to a best-efforts obligation towards the Customer. My-tennis shall not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with the law and jurisprudence.

9) INTELLECTUAL PROPERTY

All elements of the www.my-tennis.fr website are protected by copyright. They are the exclusive property of My-tennis. Any reproduction of the site, in whole or in part, for commercial purposes without the agreement of My-tennis constitutes an infringement of copyright under the French Intellectual Property Code.

10) COMPETENT COURT

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. Failing amicable resolution, the dispute will be referred to the Paris Commercial Court.
